General warranty

You’ll receive at least a 2-year on manufacturing defects on all products. Your product shouldn’t break during the first 2 years with normal use.

Custom made parts, deadstock parts

Custom and Deadstock Parts and products made on behalf of customers based on information are non-refundable once the order is fulfilled at the factories. 

Validity

These general terms and conditions apply to all offers and to all agreements made to or entered into with third parties. They form an integral part of the offers and/or agreements.

Full or partial deviation from these terms and conditions is only possible if and insofar as agreed in writing.

The nullity or voidability of any provisions of these terms and conditions, or of the agreements concluded under these terms and conditions, shall not affect the other provisions.

Offers-sales

All offers, in whatever form made by RareVW, are without obligation and must be considered as a whole, unless expressly stated otherwise in writing.

Images, drawings, size and weight specifications, etc., which RareVW makes known are not binding for RareVW and are only intended to give a general representation of what RareVW offers. Deviations do not entitle the buyer to refuse receipt of the products and/or goods or to refuse payment thereof or to demand any compensation from RareVW.

RareVW reserves the right at all times to refuse orders without giving any reason.

Agreements

Orders are only accepted at rates as they apply on the day of delivery, unless the price and/or discount has been expressly agreed upon when the order is accepted and this has/have been confirmed or accepted in writing by RareVW. No rights can be derived from old publications in which rates and discounts are mentioned other than the rates and discounts set by RareVW for the relevant order.

Most articles (if mentioned elsewhere by RareVW) mentioned prices include VAT.

Shipping and transport of products and goods is at the expense of the buyer according to the rates on the site

Products and/or items that are not kept in stock by RareVW can be ordered or requested by RareVW on behalf of the customer at any time. The buyer undertakes to purchase these products and/or items specially ordered for him. Products and/or items specially ordered by RareVW will not be taken back by RareVW after delivery and may not be refused by the customer.

Agreements are only binding on the parties after written confirmation or acceptance by RareVW.

Any additional agreements or changes made later are only valid if they have been accepted by RareVW, or if they have been confirmed in writing by RareVW and against this within 3 working days after sending the confirmation.

Assembly or installation work and facilities are at the expense of the buyer, unless agreed otherwise in writing.

Delivery time

The agreed delivery time never counts as a strict deadline, unless otherwise agreed in writing. In the event of late delivery, the buyer must give RareVW written notice of default and allow it a reasonable period of time to still fulfill its obligations.

Partial deliveries

RareVW is entitled to deliver sold goods in parts. This does not apply if a partial delivery has no independent value. If the goods are delivered in parts, RarevW is entitled to invoice each part separately. In the case of partial deliveries, the transport costs are for the account of RareVW, unless stated otherwise.

Cancellation

The buyer is entitled to cancel an agreement if the buyer has made this known to RareVW in writing. RareVW must immediately confirm the written cancellation, so that the agreement can be declared null and void.

Specially ordered or produced goods and/or items for the buyer can never be canceled by the buyer. These goods and/or items cannot be returned and may not be refused by the customer.

Guarantee

The warranty period starts at the time of delivery and only applies to new items that are in stock or can be delivered, so not to custom and deadstock parts.

No warranty is provided on used items unless otherwise agreed in writing. All used parts supplied by RarevW are working and have been disassembled in the described condition. Used goods can be recognized by the * preceding the description.

The warranty is only provided to the first owner.

With due observance of what has been stated elsewhere in these general terms and conditions, RareVW guarantees the quality or proper functioning of products and/or items supplied by third parties, but this guarantee never extends beyond the guarantee given to RareVW by its suppliers.

RareVW will inform the buyer on request of any manufacturer’s warranty with regard to products and/or goods supplied by RareVW. Products and/or items supplied by RareVW that fall under the manufacturer’s warranty must be sent carriage paid to RareVW for warranty assessment. RareVW undertakes to support any warranty claims of the customer against the manufacturer that appear to be valid.

The guarantee does not cover defects in the goods that have arisen as a result of normal wear and tear, or due to any external cause such as incorrect assembly.

The right to warranty lapses if the item has been used incorrectly or carelessly, or if any (repair) work or changes have been carried out or made to the item without the prior written permission of the supplier, unless these activities or changes are inherent to the use. taking the case.

Assembly or installation work for the repair of the warranty is not eligible for warranty compensation.

If the buyer invokes a warranty, the buyer must enable RareVW within 14 days after receipt of the warranty invocation to examine the matter in question at a location to be determined by RareVW.

Liability

RareVW is never obliged to pay compensation for direct or indirect damage, in any form whatsoever, caused by the use of products and/or goods supplied by RareVW, unless the aforementioned damage was caused by intent or gross negligence on the part of RareVW.

RareVW is not liable for any damage or depreciation of products and/or items that occur during shipment.

With due observance of the foregoing, the liability of RareVW never extends beyond the coverage of the company liability insurance it has taken out.

In the stipulations in the above articles, the liability of RareVW is excluded insofar as this does not conflict with mandatory legal provisions.

Retention of title

Until all claims that RareVW has or will acquire against the customer, for whatever reason, have been paid in full, the delivered products and/or goods remain at the expense and risk of the customer and, whether processed or unprocessed, remain the exclusive property of RareVW.

The customer is not authorized to pledge or transfer ownership of these products and/or goods to third parties.

If the customer fails to fulfill any obligation under an agreement concluded with RareVW, then RareVW is entitled to take back the products and/or goods without any notice of default being required, while the buyer is then obliged to deliver the products and/or goods to RareVW carriage paid on first demand. return. In the event that RareVW invokes the retention of title, the agreement will also be dissolved without judicial intervention, without prejudice to RareVW’s right to claim compensation for damage, loss of profit and interest.

Complaints, complaint terms, suspension and dissolution

Complaints, such as on the implementation of the agreement as well as on invoices, can only be received if they have been submitted in writing and by registered mail, within 14 days after becoming aware of the fact about which the complaint is made, or after invoices have been sent.

The buyer must examine the delivered goods upon delivery. In doing so, the buyer must check whether the delivered goods comply with the agreement; whether the goods have been delivered correctly; whether the quantity and number of the delivered goods correspond to what has been agreed; whether the delivered goods meet the requirements that may be set for normal use and/or trading purposes. As a customer of RareVW you are entitled to a sound product.

If visible defects or shortcomings are found, the buyer must immediately pass this on to RareVW.

Non-visible defects must be reported to RareVW in writing and with reasons, stating the invoice details, within 30 days after delivery, or at least after observation was reasonably possible.

Complaints about invoices must be reported to RareVW in writing within 8 days of the invoice date.

If the other party does not report defects or complaints within the aforementioned periods, its complaint will not be processed and its rights will lapse.

Returns by the customer can only lead to dissolution of the agreement if and in so far as RareVW has agreed to this. The return shipment must be sent carriage paid and must always be accompanied by a specification stating the invoice number with which the products and/or items have been invoiced.

Force majeure includes all involuntary malfunctions or impediments that make the execution of the agreement more expensive or more difficult, such as storm damage and other natural disasters, impediments by third parties, full or partial strikes, lockouts, riots, both in this country and in the country of origin. origin of materials, war or danger of war here or in other countries, loss of replaceable employees, excessive absenteeism of staff, extraordinary circumstances such as export and import bans, restrictive measures by any government, fire and other accidents in the company, lack of or breakdowns in means of transportation, non or late delivery of goods by suppliers, failure of electricity and in general all circumstances, events, causes and consequences beyond the control or control of RareVW.

If the execution of the agreement is suspended as a result of force majeure, the person on whose behalf or at whose request the suspension takes place is obliged to opt for execution or full or partial dissolution of the agreement within 14 days.

In the event of dissolution or suspension of the agreement by RareVW as a result of force majeure, RareVW will not be obliged to pay any compensation in any form whatsoever.

Return policy and legal trial period.

RareVW has a return policy regarding return requests and cancellations. In all situations, use is made of the return form which can be found under the customer service / return policy.

The following situations can occur:

A) Returns based on the legal trial period of 14 days. If you order an item that you find upon receipt does not meet your expectations or for another legitimate reason. There is no problem within the legal trial period of 14 days, provided that: the item has not been specially ordered for you, is used and cannot be sold (no damaged packaging and broken seals).

B) The 14-day trial period starts the moment you receive the item. In the case of a partial delivery, the approval period starts at the moment the last item is received by you. C) The costs for return shipping are not reimbursed by RareVW, these are for the account of the buyer. The shipping costs paid for the order will be reimbursed, unless it concerns 1 product from an order with multiple products.

D) After the statutory period of 14 days, 25% return costs will be charged for handling the return request. In most cases you can also exchange the item.
